Docs: Man taken into custody after alleged Indianapolis kidnapping, rape

INDIANAPOLIS — Police arrested a man after an alleged kidnapping and rape on the northeast side of Indianapolis on Saturday.

According to court records, officers with the Indianapolis Metropolitan Police Department responded to the 8600 block of Montery Road — near the intersection of 38th Street and Post Road — around 2:28 a.m. to take a report of a sexual assault. When officers arrived, they spoke with an individual who said they had been involved in an alleged kidnapping.

The individual told IMPD they had been walking along Montery Road when someone who was smoking made a remark to them in Spanish. According to court records, the person tried to brush off the comments and said they did not speak Spanish.

Police later identified the individual who made the remarks as 46-year-old Jose Vasquez.

The victim told officers that Vasquez got into a red 2002 Pontiac Aztec after the interaction and began following them. Court documents state that Vasquez eventually pulled up alongside the victim and forced them into the vehicle.

After the alleged abduction, Vasquez drove to a nearby cul-de-sac and started undressing inside the car. As he began to remove his clothes, the victim kicked him out of the vehicle. Vasquez then reportedly ran away from the car naked.

The victim initially attempted to escape but realized some of their belongings were still inside the car. When they returned, Vasquez tried to force them back into the vehicle.

The victim fought him off again, and Vasquez fled the scene in the Pontiac. As he drove away, he struck several garbage cans along Aspen Court.

The victim told officers that Vasquez attempted to remove their clothing during the encounter and grabbed them while forcing them into the car.

During the investigation, police learned that the victim’s friends later located Vasquez’s home address. Vasquez told investigators that the victim’s friends came to his house and assaulted him.

Officers observed that both the victim and Vasquez had visible injuries from their encounters.

According to an affidavit, the Pontiac Vasquez allegedly used did not belong to him. When officers asked if he had ever used the vehicle, Vasquez denied it.

Police did not find the key to the Pontiac during the investigation, and authorities later towed the car to an auto return lot.

After officers read Vasquez his rights, he said he understood them. When asked if he wanted to make a statement, he declined.

Officers also noted that Vasquez never asked why they placed him in handcuffs and arrested him.

Marion County Jail records show authorities booked Vasquez on Saturday. His case does not yet list a bond amount.

Vasquez faces multiple preliminary charges, though officials have not formally filed them, according to Indiana’s public court reporting system.

  • Six counts of resisting law enforcement — a Class A Misdemeanor
  • One count of theft — a Class A Misdemeanor
  • One count of kidnapping using a vehicle — a Level 5 Felony
  • One count of battery resulting in injury — a Class A Misdemeanor
  • One count of rape — a Level 3 Felony

Vasquez’s booking card indicates a federal detainer request was made regarding Vasquez. Marion County Jail logs do not specify which agency made the request.

Vasquez is due to appear in court on Wednesday. Court records indicate Vasquez was previously charged with resisting law enforcement in 2014 and theft in 2016. Both of his previous charges were misdemeanors.
