Kentucky Education Officials Clarify Non-Traditional Instruction Regulations

The Kentucky Department of Education’s Local Superintendents Advisory Council recently approved amendments to clarify rules for Non-Traditional Instruction (NTI) days.

Mathew Courtney, Policy Advisor for the Kentucky Department of Education, said the updates aim to improve transparency in how NTI days are implemented.

“You have always had to collect evidence of student learning. The plan for how you collect that is a little opaque. So, we are asking districts to clarify that as well as the name and contact information for that district NTI point of contact, so the public knows who that is,” Courtney said.

Each district will now designate a point of contact to openly communicate with the community and answer questions from guardians and teachers regarding NTI days.

Under the new rules, teachers must provide at least one piece of evidence for each class they teach on NTI days.

“We’ve expanded the list of what counts as evidence of clear continuation of learning. In addition to examples of student work and lesson plans, we now allow reports from online learning management systems, examples of teacher-student communication, or other documentation deemed appropriate,” Courtney said.

Courtney added that each superintendent must submit an NTI plan for annual approval, and any changes to the plan require board review and approval.

Districts that fail to comply will lose the ability to use NTI days and must count canceled school days at the end of the school year. A corrective process is available to help districts regain NTI privileges.
