LOUISVILLE, Ky. (WAVE) – A judge declared a mistrial in the case of a Louisville mother accused of fatally shooting her 10-year-old son in 2021.

Judge Mitch Perry declared the mistrial Wednesday in the case of Kaitlyn Higgins and asked to review evidence in the case. The reason for the decision has not yet been released.

WAVE News learned that Higgins will return to court Thursday to meet with the judge and discuss a possible retrial.

The case began Tuesday, with prosecutors alleging that Higgins attempted to perform an exorcism on her son before killing him.

Prosecutors said the crime occurred in April 2021 at a home on Algonquin Parkway.

Police said they received a call on the day of the murder from someone who reported seeing Higgins with a gun and a boy wrapped in a blanket.

Officers later found 10-year-old Kyan Higgins Jr. dead in the trunk of her car.

According to police, his mother told investigators she also tried to cut out his tongue. Prosecutors said she was high on meth when she taped the boy to a chair, punched him, and stabbed him.

The case has led to a 2025 Kentucky bill that would provide animal control officers with training to recognize signs of child abuse and neglect.

Records show that Metro Animal Services had previously cited Kyan’s mother for animal neglect before his death.

Future court dates will be scheduled at a later time.
