LEXINGTON, Ky. (FOX 56) — A federal judge has approved a request to delay the trial of Brian Epperson by 90 days.

Epperson’s defense filed the motion on Jan. 12, asking for at least a three-month postponement. He pleaded not guilty on Oct. 16, 2025, to a federal indictment that links him to the overdose deaths of two women in May and July 2025.

The trial had been scheduled to begin Feb. 2 under the Speedy Trial Act, which generally requires a criminal trial to start within 70 days of indictment. Court records show Epperson was arraigned on Nov. 24, 2025, meeting that requirement.

In the motion, defense attorneys said additional time is necessary to adequately review and analyze discovery materials and to properly prepare for trial. They also noted the delay would allow Epperson to make informed decisions regarding his case.

Epperson’s next court appearance is set for 8:30 a.m. on May 6 at the U.S. District Courthouse in Lexington. Pretrial deadlines will be reset based on the new trial schedule.
