Kentucky Woman Charged With Fetal Homicide After Alleged At-Home Abortion and Burial

WOLFE COUNTY, Ky. (WKRC) — Authorities arrested a Kentucky woman after she allegedly performed an abortion at her home and buried the fetus on her property.

According to WKYT, 35-year-old Melinda S. Spencer of Campton was taken into custody after clinic staff reported that she admitted to aborting her pregnancy at home and burying a child.

The investigation began around 2:30 p.m. when Kentucky State Police received a call from clinic personnel. Troopers responded to the clinic and interviewed Spencer, who reportedly said she had ordered abortion medication online.

WKYT reported that after taking the medication, a developed male fetus died. Spencer allegedly told investigators she buried the child in a shallow grave on her property. Law enforcement later located and recovered the infant, according to the report.

Spencer was charged with the following offenses, per WKYT:

  • First-degree fetal homicide

  • Abuse of a corpse

  • Tampering with evidence

An autopsy will determine the gestational age of the fetus, WKYT reported. The investigation remains ongoing.

Spencer told WKYT reporters that she had been advised not to speak publicly about the case.

Kentucky enforces a near-total abortion ban. State law allows the procedure only when necessary to prevent the death or critical injury of the mother, with no exceptions for rape or incest.

There is currently no Kentucky law prohibiting travel to another state to obtain abortion care.
